These Terms of Service ("Terms") govern your use of CLUTCH Tournaments ("CLUTCH", "we", "us") — a Discord bot and the website at tournaments.clutch.game. By adding the bot to a server, signing in to the dashboard, or taking part in a tournament run with it, you agree to these Terms. If you don't agree, don't use the service.
In plain terms. Use CLUTCH to run and play tournaments, follow Discord's rules and don't abuse the service, understand that paid plans renew until cancelled, and know that the service is provided "as is." Your data is handled per our Privacy Policy.
1Eligibility
To use CLUTCH you must meet Discord's minimum age requirement for your country and comply with the Discord Terms of Service and Community Guidelines. If you use CLUTCH on behalf of a server, community, or organization, you confirm you're authorized to accept these Terms for it.
2The service
CLUTCH lets server administrators create and run competitive tournaments — signups, bracket and lobby generation, match rooms, result and score tracking, live web brackets and standings, and related tools. Features available to you depend on your plan (see Plans & billing). We may add, change, or remove features over time to improve or maintain the service.
3Acceptable use
You agree not to:
- Use CLUTCH for any unlawful purpose, or in violation of Discord's Terms or Community Guidelines.
- Abuse, disrupt, overload, or attempt to gain unauthorized access to the bot, the website, our infrastructure, or other users' data.
- Reverse engineer, scrape, or resell the service except through officially offered plans or APIs.
- Use CLUTCH to harass others or to post or distribute harmful, hateful, or infringing content.
- Interfere with the integrity of a tournament you're taking part in (for example, falsifying results) contrary to that event's rules.
We may suspend or remove access — for a user or a whole server — that we reasonably believe breaks these Terms or puts the service or its users at risk.
4Tournaments and organizers
Tournaments are created and run by independent server administrators ("organizers"), not by CLUTCH. Organizers are responsible for their events: the rules, eligibility, conduct, scheduling, results, and any prizes. CLUTCH provides the tooling but is not a party to, organizer of, or guarantor of any tournament, and is not responsible for disputes between organizers and participants or for any prizes offered. If you organize an event, you're responsible for running it fairly and lawfully.
5Plans & billing
- Free plan. Core tournament features are available at no cost, subject to the limits described on our site.
- Paid plans. Paid subscriptions unlock additional features and higher limits. Prices and what each plan includes are shown in-product (for example via
/subscribe plans) and on our site. - Payments. Paid plans are billed through Stripe. Subscriptions renew automatically each billing period until cancelled.
- Cancellation. You can cancel at any time through the billing portal; your plan stays active until the end of the current paid period, after which it reverts to Free. Except where required by law, payments already made are non-refundable.
- Changes. We may change plans, features, or pricing. Where changes affect an active paid subscription, we'll give reasonable notice.
6Your content and data
You keep ownership of the content you provide (tournament names, descriptions, and similar). By using CLUTCH, you grant us the limited right to store, process, and display that content as needed to operate the service — for example showing entrants and results on the live bracket. How we handle personal data is described in our Privacy Policy.
7Intellectual property
CLUTCH, its name, logo, website, and software are owned by us and protected by intellectual property laws. These Terms don't grant you any right to our branding or code beyond using the service as intended. Game names, logos, and trademarks referenced in game presets belong to their respective owners and are used only to identify those games.
8Third-party services
CLUTCH relies on third parties including Discord (the platform), Stripe (payments), and our hosting provider. Your use of those services is subject to their own terms, and we're not responsible for their availability or actions.
9Availability & disclaimer
We work to keep CLUTCH reliable, but the service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. We don't guarantee that tournaments, results, or the website will always be available or free of bugs.
10Limitation of liability
To the maximum extent permitted by law, CLUTCH and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or losses arising from tournaments, prizes, or disputes between users. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the three months before the claim (or, if you use the Free plan, is limited to zero). Some jurisdictions don't allow certain limitations, in which case those limitations apply only to the extent permitted.
11Indemnity
You agree to indemnify and hold harmless CLUTCH and its operators from claims, damages, and costs arising out of your misuse of the service, your violation of these Terms, or, if you're an organizer, the tournaments you run.
12Termination
You can stop using CLUTCH at any time by removing the bot from your server. We may suspend or terminate access if you breach these Terms or to protect the service or its users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnity) will continue to apply.
13Changes to these Terms
We may update these Terms as the service evolves. When we make material changes, we'll update the "Last updated" date above and, where appropriate, note it in our Discord. Continued use after an update means you accept the revised Terms.
